The Akhil Bharat Hindu Mahasabha has levelled serious allegations against an empanelled advocate of the Aligarh Bar Council and has demanded disciplinary action against him. The organization alleges that the advocate issued a misleading statement in the name of the Mahasabha without any official authorization, thereby damaging the reputation of the organization.
The complaint has been addressed to the President of the Aligarh Bar Council/Bar Association, accusing the concerned advocate, Gajendra Pal Singh, of “misuse of professional conduct.”
What is the matter about
Recently, in the murder case of showroom owner Abhishek Gupta in Aligarh, the name of Mahamandaleshwar Annapurna Bharti (formerly Pooja Shakun Pandey) surfaced. In connection with this case, an advocate reportedly released a media note claiming that the accused woman was a leader of the Akhil Bharat Hindu Mahasabha and that Munna Sharma was the national president of the organization.
The Mahasabha has refuted the statement outright, calling it completely false. The organization maintains that Munna Sharma is neither an office-bearer of the Mahasabha nor recognized at any level. The complaint alleges that such a statement was made deliberately to “associate the organization with a criminal act” and to tarnish its image.
What the complaint says
The complaint states —“Advocate Gajendra Singh, without any authority or verification, released false information to the media, misleading the public. This conduct is against the dignity of the legal profession and is objectionable even in the eyes of law.”
The organization has requested the Bar Council to investigate the matter and initiate disciplinary proceedings against the advocate concerned.
Court rulings cited
The complaint is accompanied by copies of two Delhi court judgments which reportedly state that Munna Sharma is not authorized to represent the Akhil Bharat Hindu Mahasabha.
MCD Appeal No. 05/2005 (Patiala House Court, New Delhi) — The court held that Munna Sharma cannot represent himself on behalf of the Mahasabha.
Appeal No. 747/ATMCD/2014 (Tis Hazari Court, Delhi) — The court found that Munna Sharma had wrongfully claimed ownership and representation of the organization and had not approached the tribunal with clean hands.
The organization’s demand
The Mahasabha has stated that such advocates who misuse their professional stature to spread misinformation in the name of reputed organizations should face exemplary disciplinary action.
“The false statement has adversely affected the dignity of our organization and the hard work of thousands of members. Therefore, it is necessary for the Bar Council to take this matter seriously and act accordingly,” the complaint reads.
All eyes on the Bar Council
Following the complaint, attention is now focused on the Aligarh Bar Council, which must determine how seriously it views this alleged breach of professional ethics.
Meanwhile, the issue has become a topic of discussion in legal circles — whether any advocate has the right to issue statements on behalf of an organization without formal authorization.
